NOBLE — A police bullet that killed a small boy last week had been aimed at a black rat snake, a Norman animal control officer said Tuesday.

After the shooting on Friday that killed Austin Haley, 5, Norman's animal control department was called to collect and store the dead snake, Noble City Manager Bob Wade said.

Noble doesn't have an animal control officer, he said.

The snake has been frozen and stored for investigators, Norman Police Chief Phil Cotton said.

The incident started when Noble police officers responded to a call from a resident who thought a rattlesnake had slithered up into a birdhouse.

One of the two shots fired by police hit Austin while he was out fishing with his grandfather. His funeral is today.

Noble Police Chief Ben Daves said the city has been without an animal control officer for about a month, so police responded.

The Noble Police Department's Police and Procedures Manual says "firearms may be used to destroy an animal that represents a threat to public safety.”

The manual states "firearms shall not be discharged when it appears likely that an innocent person may be injured.”

The three officers involved in the shooting are on paid administrative leave pending the outcome of investigations by Noble and the OSBI.

The names of the officers involved have not been released.

In the meantime, the seven officers remaining on the police force are working overtime to cover the shifts, Daves said.

This is a tragic accident that could have been avoided with a little common knowledge everyone in Oklahoma should know:
•How many different types of poisonous snakes are in Oklahoma? Three, rattlesnake, copperhead and water moccasin (cottonmouth).
•How do you know the difference between the poisonous and non-poisonous snakes in Oklahoma? The poisonous snakes in Oklahoma are pit vipers. Their heads are shaped like a triangle; they have scent pits and their eyes like a cat. Non-poisonous snake have pupils like ours – they are round.
The King Snake should not be killed because it will eat any of these snakes.

I feel that police have lives to save and crimes to stop and their time is important. Police should not have wasted time responding to a snake call. This is Oklahoma and we have snakes, get used to it. I'd hate to think of my family being the victim of a home invasion and being held at gunpoint only to hear the 911 operater telling me all units are responding to a snake in a birdhouse or a cat in a freaking tree. Anyone who wastes police time on crap like this should be prosecuted.

This is tragic for everyone involved. So who here knows the whole story behind it all? Hmm as one puts it was it a coverup of a intoxicated officer?(what a idiot for thinking so.) It looks like a accident, plan and simple! I do agree now that it is done, seems thing could have turned out different with another plan of action on part of the PD. But as always, let the digging begin! My sympathy to the family and community of Noble.

Only retarded morons kill snakes. These are the fools who think all snakes may be poisonous or descended from the devil. They are like the re-tards from the middle ages who killed cats because their eyes glowed at night. Leave the damn snakes alone you ignorant re-tards...and I don't mean Oklahomans, I mean all over the country there are dumb-bells killing snakes out of sheer ignorance. In this case, ignorance, combined with gun handling stupidity and disregard for safety, killed a little boy. Also, I hope they expose the idiot who called the police to report a snake in the first place. Should we start calling the police to report spiders as well? This meddlesome moron should be made to pay for setting up this situation in the first place.

An accident is something that happens by chance without apparent cause. This childs death is a result of a bad decision made by the officer. I am sure no one thinks he meant to kill Austin, but he used poor judgement in a situation that was not an immediate threat to anyone.
My 5 year old son became ill suddenly and died in Dec. at the hands of a very well trained medical proffesional. He was properly trained, but when the situation arose, he used poor judgement that went against what his training provided and my son was left brain dead as a result.
To the person who commented that this family will in time learn to live with this childs death,but the officer will never forget, I would say that I pray that you will never have to truly understand the ignorance of your statement. What this family and this officer will have to live with in no way compare.
I can say with all honesty that as a Christian and by the grace of God, I have forgiven the person responsible for my son's death. However, forgiving does not equal dismissing responsibility.
Our choices have consequences, and sometimes they devastate the lives of innocent people.

Funny how the dump truck driver in OKC was immediatly put in jail for "accidently" running over a 14 year old, but the police officer who committed the same type of "accident" is on "paid administrative leave. I live in Noble, the whole community is heartbroken. We need some answers........

I had a gut feeling the snake would be a rat snake due to its location and being in a bird house. Noble is WAY out of the range of the venomous cottonmouth and copperheads and rattle snakes generally do not like to climb very high. Rat snakes on the other hand are notorious climbers. I don't think this will make any difference even though it should. Had the cop been shooting at a golden retriever because someone said it was a pitbull and killed a kid then people would care.

In the policeman's shoes??? I would not have shot at a snake in a tree in the first place!!This was not 'JUST AN ACCIDENT' these 2 idiots made a concious decision to shoot twice at this harmless snake in a tree not threatening them - AND without checking or securing the area - this is negligent homicide plain and simple. - their own procedure says that - "gun is fired only if public safety is threatened." If the mexican truck driver's face can be plastered all over the media and he is charged right off the bat with negligent homicide -the shooters picture needs to be put right out there too - This story better not be allowed to die like that child!

this was a terrible accident i cannot believe so many are wanting to shame the whole pd in noble. let the families on both sides grieve. try to put yourself in each of their shoes. each family will have different lives now. hopefully each can live in peace.

Ya'll be sure and read the story about the DHS director getting cleared by the AG. Its hard to expect much from the bottom when the top of the law enforcement food chain can't BUY enough whitewash to protect the head of a state agency thats so badly bungles so much ( ie Kelsey Briggs)

I had wondered for days about what kind of snake was being dispatched, and told several friends I'd give 100 to 1 odds it was non-poisonous. This whole situation demonstrates blatant disregard for public safety and a lack of common sense on the part of Noble PD. As to the snakes, I agree with Dan, and, unless a snake is venomous, it is welcome on my property.

Two things about this incident are inexcusable. First, the reckless use of a firearm by a supposedly trained police officer. Second, the preferential treatment by the City of Noble and the press. If a regular citizen had fired that weapon, their name and face would be all over the television and newspaper. And they would be facing a battery of charges, probably including negligent homicide.
It's this kind of 'protect your own' mentality and double standards that cause people to lose faith in law enforcement.
Charge the policeman, and let the legal system run its course....just as would happen to anyone else. Or is something being covered up? Perhaps this is a case of Noble police officers drinking while on duty?

This was a tragic and useless death...I attribute it to gross ignorance and over-reaction...The majority of snakes found in Oklahoma are harmless to humans and actually beneficial...they help control the rodent population without using chemicals that may not be so harmless to animals and people...I will cheerfully volunteer to remove snakes in an effort to prevent further tragedies like this from happening in the future...Snakes have caused hysteria for thousands of years...mostly unjustified...they are fellow travelers on spaceship Earth.

I have resided in Noble seven years and if this is the decision making skills of the city's police officers then I suggest the city revamp the entire force .
