In Oklahoma, home day cares and child care centers outside homes are prohibited from employing individuals who have been convicted, pleaded guilty, pleaded no contest or have pending charges against them for certain types of crimes, unless they obtain waivers from the Department of Human Services.
Crimes covered by the ban include:
•Child abuse or neglect.
•Crimes of violence against a person.
•Crimes involving illegal drugs.
•Criminal acts involving gross irresponsibility or disregard for the safety of others.
•Acts that show a pattern of criminal activity.
With home day cares, every adult who lives in the homes must also undergo criminal background investigations.
Registered sex offenders are prohibited from being in home day cares and child care centers. They are not allowed to obtain waivers.
