Joshua died hours after he was injured at a Tulsa day care. The day care owner, Vicki Chiles, 44, admitted using masking tape to tape up his hands and mouth because he wouldn't stop whining at nap time. She is serving a life sentence without the possibility of parole for first-degree murder. At her formal sentencing, she said, "Please forgive me, not today, but in the future."
The Department of Human Services faced extensive criticism and made changes because of the death. Joshua's parents said they would have removed their children from Chiles' care if they had known DHS had investigated her and already substantiated she abused an 8-year-old boy with a flyswatter at the day care a month before.
DHS workers went to her day care on May 17, 2007, to ask her to shut down, one day after she was charged in court with child abuse for swatting the 8-year-old. They found her trying to revive Joshua. DHS issued an emergency closure order on May 18, 2007, and served it on her in jail.
Joshua's parents are suing DHS over the death.
