EDMOND — Emil L. Coffey doesn't want a car wash in his Edmond neighborhood. So, he is using an appeal process that has not been used since the city rewrote its zoning code nearly five years ago.
Coffey, a retired Boeing engineer, disagreed with the planning commission's Jan. 3 approval of a car wash site plan on Santa Fe Avenue across from the Walmart Supercenter.
The new zoning code gives the planning commissioners the only say on site plans without variances. Most all other action taken by the planning commission has to go to the city council for final approval.
An appeal process is included in the new code. City Attorney Steve Murdock said this is the first time an appeal has been made.
Council members will consider the appeal at 5:30 p.m. Monday during their meeting at 20 S Littler Ave.
Planning commissioners approved by a 3-2 vote the site plan for Okie Express Car Wash requested by owner Mike North.
Residents of the nearby Orchards at Trails housing addition were against the car wash, calling it an “industrial-type business.” They also were concerned about water runoff and noise.
Coffey lives at 1017 Bradford Place, within 300 feet of the proposed development. He wrote in his appeal letter that he disagrees with the planning commission that the developer should only be required to install a 6-foot fence between the homeowner's property and the car wash.
