PAWNEE — The family of a man fatally shot by the Pawnee assistant police chief has filed a wrongful death lawsuit on the two-year anniversary of the shooting.

The estate of 25-year-old James Dylan Gonzales filed the suit Tuesday. The suit seeks more than $75,000 in damages and claims that the Pawnee Police Department used excessive force.

Police say Gonzales was a burglary suspect who led Assistant Chief Calvin Brown on a foot chase, then barricaded himself inside an abandoned nursing home. Police say Gonzales stabbed Brown in the face, and Brown then shot him.

Police Chief Herb Adson tells a local newspaper that Brown has recovered from the stabbing and remains assistant chief.
