Oklahoma judge rules doctor won't stand trial in patient's death

Dr. Mickey Ray Tyrrell, 40, of Vinita, had been charged in Craig County District Court with second-degree manslaughter in the death of Tammy Dawn Daniels, 35, of Vinita. Special Judge Rebecca Gore ruled there wasn't enough evidence linking the doctor to the woman's death.

— A Craig County judge has ruled there isn't enough evidence for a physician to stand trial in connection with a patient's prescription drug overdose, a prosecutor said Friday.

Dr. Mickey Ray Tyrrell, 40, of Vinita, was charged in Craig County District Court with second-degree manslaughter in the death of Tammy Dawn Daniels, 35, of Vinita.

Special Judge Rebecca Gore made the ruling after a six-hour preliminary hearing Thursday.

“She said she did not find a strong link between the doctor's actions causing the patient's death,” said Marny Hill, assistant district attorney.

Tyrrell is a general practitioner with Green Country Family Medicine in Vinita.

Hill said a decision on whether to appeal the ruling will be made before Tuesday.

Robert Rush, Tyrrell's attorney, did not return telephone calls.

Daniels died Sept. 5, 2009, from acute combined drug toxicity from forms of the painkiller Demerol, according to the state medical examiner. Tyrrell had been treating her for four years for interstitial cystitis for an irritated bladder.

Court records show Tyrrell prescribed more than 630 50-mg Demerol pills to Daniels between July 7 and Sept. 2, 2009.
