Oklahoma court denies hearing for death row inmate Ricky Ray Malone

An Oklahoma appeals court has denied a death row inmate's request for a hearing to present evidence in his appeal.

An Oklahoma appeals court has denied a death row inmate's request for a hearing to present evidence in his appeal.

The state Court of Criminal Appeals handed down the decision Tuesday in the case of 38-year-old Ricky Ray Malone.

A jury in Comanche County convicted Malone of first-degree murder and sentenced him to death for the December 2003 killing of Oklahoma Highway Patrol Trooper Nikky “Nik” Green.

Green was shot to death with his own gun while trying to arrest Malone for allegedly operating a mobile methamphetamine lab out of Malone's sister's car. Some of the attack was captured on Green's vehicle's dash-cam.

Among other things, Malone asked the state appeals court for a hearing to produce evidence that his defense attorneys have been ineffective during his trial and appeal.
