LAWTON (AP) — The murder trial of a Lawton man is being delayed for a third time, the latest delay due to the death of his defense attorney.
Jimmy Nazario Jr., 22, was scheduled for trial on a second-degree murder charge in October, but defense attorney Kenneth Rhoads was killed in a motorcycle accident in July.
The Lawton-Constitution reported that Comanche County District Judge Keith Aycock on Tuesday agreed to postpone the start of the trial at the request of new defense attorney Jordan Cabelka.
A new trial date was not immediately scheduled.
Nazario is charged in the December 2011 shooting death of Ervin Manigault outside a west Lawton apartment complex. Authorities say Manigault, 26, was found face down with gunshot wounds to his chest and back.
Nazario has pleaded not guilty.
Nazario was initially scheduled for trial in February, but it was delayed because the judge was ill. A second trial date in May was postponed at the request of prosecutors.
