Colcord man convicted of murder

JAY — A Delaware County jury deliberated for seven hours Wednesday before convicting a Colcord man of murder and recommending he serve 10 years in prison.

Timothy Duane Bales, 26, of rural Colcord, was convicted in Delaware County District Court in Jay with second-degree murder in the Sept. 18 shooting death of Robert Ferel Alberty, 34.

The three-day trial ended after the jurors came back around 11 p.m. with the verdict, District Attorney Eddie Wyant said.

Bales' attorney argued the shooting was self-defense.

Bales was accused of shooting Alberty as the two argued. Bales told Colcord police he shot Alberty as the victim reached for a rifle. Police said Bales used a pistol he grabbed from the back of a friend's pants.

Alberty was found in the front seat of his pickup truck with a gunshot wound to the head, court records show. has disabled the comments for this article.
