OKLAHOMA CITY (AP) — An Oklahoma County judge will decide whether a man accused of killing four family members is mentally incompetent to be tried for murder.

A hearing is scheduled Wednesday for 40-year-old Daniel Green. Green’s defense attorney has filed a motion to determine whether Green is competent to be tried on four counts of first-degree murder.

The motion alleges that Green is schizophrenic and has a documented 19-year mental health history. It also says Green is unable to understand his attorney.

Green is accused in the Aug. 14 shooting deaths of his mother, 57-year-old Sallie Green; sister, 34-year-old Rebecca Cizek; his sister’s daughter, 16-year-old Katherine Cizek; and her 7-month-old son, Amario Dominguez III. Investigators say the victims lived at a southeast Oklahoma City house with Daniel Green.
