Court considers whether Tulsa teen should be tried as an adult

OKLAHOMA CITY — The state Court of Criminal Appeals on Thursday heard oral arguments about whether a Tulsa County second-degree murder defendant should be tried as an adult.

Theo Fleming, 17, is appealing a lower court's July 22 decision that he be tried as an adult for the April 4 fatal shooting of Kaitlyn Finnegan, a senior at Bishop Kelley High School.

Finnegan, 18, was shot once in chest at a house at 5837 S. 94th East Place. The court did not immediately issue a ruling on Thursday.

Fleming's attorney, Thomas Mortensen, said the lower court abused its discretion in determining that Fleming should be tried as an adult.
