A Del City police captain charged with manslaughter is asking a judge to dismiss the case.

A Del City police captain charged with manslaughter is asking a judge to dismiss the case.

Randy Harrison is charged with first-degree manslaughter in the March 2012 shooting death of 18-year-old Dane Scott Jr. A police affidavit says Harrison was trying to arrest Scott after a car chase and managed to take a handgun from the teen during a struggle. As Scott ran away, Harrison opened fire and struck Scott in the back.

Harrison's attorney, Doug Friesen, says charges against his client should be dropped. According to a local television station, Friesen is arguing that Oklahoma's manslaughter statute is unconstitutional for law enforcement officers.

A hearing is planned for Friday on Harrison's request to dismiss the charges. His jury trial is scheduled for next month.
