EL RENO — A judge today rescheduled a hearing on murder defendant Joshua Durcho's request to move his trial.
Canadian County District Judge Gary E. Miller delayed the hearing to June 23 for technical reasons.
Durcho, 27, is accused of strangling his girlfriend, Summer Rust, 25; her daughters, Kirsten Rust, 7, Autumn Rust, 7, and Evynn Garas, 3; and her son, Teagin Rust, 4. Their bodies were found Jan. 12, 2009, in their El Reno apartment.
Defense attorneys contend the trial needs to be moved because widespread publicity about the case has biased potential jurors. Prosecutors oppose the request. They contend the publicity came right after the deaths and there has been little in the news about the case since then.
The delay came when defense attorneys discovered they did not have sufficient statements to support their request.
By law, defense attorneys must have affidavits from three Canadian County residents who agree a trial is impossible in El Reno.
Defense attorneys had statements from three residents but then found out one had moved since signing the statement. They got a statement from another resident but then found out someone else had moved.
Defense attorneys said they will get more statements before the next hearing.
The trial is set to begin Sept. 13.
