Oklahoma rock star Wayne Coyne is admitting in court papers that his marriage cannot be fixed.

His wife, Michelle Martin-Coyne, petitioned for divorce in September on the legal ground of incompatibility.

In a counter-petition Oct. 10, The Flaming Lips singer agreed “a state of complete and irreconcilable incompatibility has arisen between the parties hereto, and exists at the present time, which has destroyed all of the legitimate aims of matrimony.”

The two disagree on when their common-law marriage began. She claims they have been married since Feb. 4, 1989. He claims they have been married since late 2004.

Unless there is a settlement, the judge will have to resolve the issue in order to determine how their marital property is divided.

The singer is 52. His wife is 45.

The case is pending before Oklahoma County Special Judge Lisa Hammond.
