George Wright, the parents' attorney, confirmed the lawsuit is related to the criminal allegations but said he didn't want to comment further because the case is sealed, in part for the privacy of the children involved.

Smothermon said he could not comment on whether Rickey Crain is also under investigation.

According to court records, Kimberly Crain invited girls to her home on Nov. 11 and asked them to pose for photos while decorating a Christmas tree.

A parent told police Kimberly Crain asked the girls to go one at a time into a bedroom and change into Christmas bras and panties with words such as “Ho, Ho” written on them. The girls also were photographed and videotaped doing a cheer dance in the underwear, records show.

Smothermon said some girls refused to put on the underwear, and Kimberly Crain forced them to do so.

An inventory of items seized from Crain's home on a search warrant included three laptop computers, a flash drive, a portable hard drive and an Apple iPod.

FBI Special Agent Clayton Simmonds said federal investigators are working with Shawnee police to determine whether the computers and digital storage devices contain anything that would warrant federal charges.

Smothermon said the FBI is helping to investigate the reported Skype conversations with “Uncle G” that children said took place in Kimberly Crain's classroom.

“We are pursuing the Skype angle to determine if there are other people involved and who that was and if any other images have been relayed to this person,” Smothermon said.
