Oklahoma County prosecutors are appealing a district court judge's denial to also bind the former lawmakers over for trial on a related conspiracy charge.
Following a preliminary hearing last year, a judge ruled there was sufficient evidence to try Terrill and Leftwich for bribery but not conspiracy.
Prosecutors claim Terrill and Leftwich were part of a scheme to set Leftwich up in an $80,000-a-year state job so a Republican colleague of Terrill's could run for her open seat. Both deny the allegations but face up to 10 years in prison if convicted.
