Judge throws out 23 felony counts in former police officer's molestation case

Maurice A. Martinez still faces 12 felony counts and two misdemeanor counts.

Martinez faces two misdemeanor counts — harboring an endangered runaway child and conspiracy to obstruct an officer. Martinez was a foster parent for 11 years and “had numerous boys under his care during those years,” police reported.

One foster son testified Monday he saw inappropriate sexual contact between Martinez and other boys in the home. Defense attorneys say the foster son is lying. The judge said Tuesday that will be for a jury to decide.

Much of the testimony Tuesday focused on the hundreds of photos of gay pornography that had been on Martinez's iPhone.

Defense attorneys do not dispute the images were on the phone.

They contend one of his boys is responsible for putting them there.

“Maurice found them. He deleted them,” his attorney said.
