Judge will rule Monday on defense request in Oklahoma City pharmacist's murder trial

An Oklahoma County judge said he will rule Monday on a defense request for him to step down from a pharmacist's murder trial.

District Judge Ray C. Elliott admitted Monday he used the word "wetbacks" to describe roofers who damaged his home. He said today he regrettably used the word after three to four weeks of problems. He said a general contractor told him the workers were illegal aliens. He denied making other negative statements about Hispanics that have been attributed to him.

The pharmacist, Jerome Jay Ersland, is white. He is accused of going too far when he fatally shot a robber last year at an Oklahoma City pharmacy.

His attorneys say the judge can't be fair to anyone.
