Jury acquits Bethany man of murder

A jury deliberated nearly 12 hours Friday before acquitting a Bethany man of murder in a fatal shooting inside a crowded Oklahoma City nightclub.

Jurors, though, did convict Kristopher Lamar Arterberry, 24, on a different charge — having a gun the night of the shooting following a previous conviction — and recommended four years in prison.

Arterberry was charged with first-degree murder in the Jan. 16, 2010, shooting death of Derrek D. Shannon, 20, inside the El Dorado nightclub, 2323 N Missouri.

Arterberry also was charged with four counts of shooting with intent to kill after four people were wounded, but those charges were dismissed, court records show.

Prosecutors argued that Arterberry killed Shannon following a fistfight and then acknowledged during a recorded jail conversation that he had a gun and was justified using it.

Two witnesses testified seeing Arterberry shoot Shannon. Two other witnesses, including a bouncer, testified seeing Arterberry run out of the club with a gun following the shooting. No gun was recovered.
