At that point, Scott charged toward Zuniga, pointing the rifle at him and flailing the machete. Zuniga fired three times, striking Scott twice. Scott was dead at the scene, Clabes said.
Zuniga is on paid administrative leave pending the outcome of the investigation.
“Our investigation has revealed that Scott apparently set some clothes belonging to the homeowner on fire inside the garage and was inadvertently burned in the process. Shortly after that, he charged officer Zuniga with the weapons and was shot,” Clabes said.
“Based on what we know from our investigation and after reviewing the video, it was clear that officer Zuniga had no choice but to use deadly force to protect himself. Scott was armed and presented an immediate danger to the officer,” Clabes said.
