It will be up to Logan County District Attorney Tom Lee to determine whether a man was justified in shooting a car thief to death Friday night, investigators said.

The Oklahoma State Bureau of Investigation and Langston police are investigating the incident but made no arrests after speaking with witnesses, an OSBI spokeswoman said Sunday.

Michael DeWayne Milton, 50, was found dead from a gunshot wound about 6:30 p.m. Friday after Langston police were called to a home in the 400 block of S Oklahoma.

Witnesses told investigators the home's owner saw someone trying to steal a car parked in front of the house and tried to stop him by reaching through the car's window to take the key.

Another man who lives at the home fired several shots from a handgun, hitting Milton at least once. He wrecked the car about a block away, investigators said.
