Man who escaped while in Oklahoma City back in custody

A man who walked out of federal court during a revocation hearing in late November is back in custody.

William Hershell Smiley, 41, contacted the U.S. Marshal’s office on Tuesday and was arrested without incident this morning, U.S. Deputy Marshal Kim Heath said.

Smiley did not say where he went after his Nov. 24 escape, but he has a girlfriend in the Oklahoma City area, Heath said.

“I don’t think he meant a lot of harm,” Heath said.

Details surrounding escape

Smiley, originally charged with filing a false or fraudulent claim, faced revocation on accusations of failing to charge his GPS ankle tracking device.

Before a Nov. 24 revocation hearing began with a U.S. District Judge, he left the courthouse. Smiley asked to use the restroom and removed the device before fleeing, Oklahoma City police Sgt. Paco Balderrama said.

The tracking device has not been found, Heath said.

The bathroom trick is in my nephew's commando book. Its there with setting a trash can on fire and setting off the sprinklers. Of course the best restroom antics in a courthouse has to go to Jim Carey. Someone asks why he's putting his head in a toilet seat and he replies, "I'm kicking my ass." Anyway, I'm sure this guy has new restroom adventures ahead as they share one between 4 inmates in most newer jails.
