Hector Mercado, a man whose family is charged in the shooting of an Oklahoma City police officer, had a prior felony conviction and re-entered the United States illegally, federal prosecutors allege.
A man whose family has been charged in the shooting of an Oklahoma City police officer was indicted Wednesday, accused of being an illegal immigrant.
The federal indictment alleges Hector Mercado, 42, was deported in 2004 after being convicted of a felony but re-entered the United States illegally.
Mercado, whose surname is listed as Mercado-Castellanos in the indictment, was the driver of a car that was pulled over Aug. 29 on suspicion of driving under the influence.
Prosecutors said his wife, Vilma Escalante, 52, and his sons, Hector E. Escalante, 18, and Alex Mercado, 17, acted together to shoot officer Katie Lawson after begging a deputy to release Hector Mercado.
Lawson is recovering from her injuries.
As the driver, Mercado is not facing charges for the shooting but may be deported. According to state court records, he was convicted of felony DUI in February 2001. His record shows another DUI arrest in January 1999.
According to court documents, Mercado was deported "about" June 16, 2004, and did not receive permission to re-enter the country.
