A Midwest City man is accused of driving drunk while his 3-year-old son was in the back seat unsecured.
Jose D. Estupinan, 27, was charged Friday in Oklahoma County District Court with child endangerment and driving under the influence, records show.
Oklahoma City police were called March 6 to a convenience store on NW 10 Street near County Line Road about a man urinating in the parking lot.
When police arrived, Estupinan was trying to back out of the parking lot, according to a probable cause affidavit. The boy was sitting in the back seat without a car seat or seat belt, police reported.
Police smelled a “strong odor of alcohol” on Estupinan's breath and he had “very red, watery eyes,” they said.
Estupinan, according to the affidavit, told police “Yes, I'm drunk” several times. He had just purchased a 24-pack of beer, and there was an open bottle of beer in the center console of his car, police said.
He was arrested and booked in the Oklahoma County jail, records show.
