Mistrial declared in LeFlore County child neglect and sexual abuse case

POTEAU — A judge has declared a mistrial in the case of a LeFlore County man accused of child neglect and sexual abuse, finding that too many potential jurors had already formed opinions on the case.

POTEAU — A judge has declared a mistrial in the case of a LeFlore County man accused of child neglect and sexual abuse, finding that too many potential jurors had already formed opinions on the case.

The 62-year-old man was charged with nine counts of felony child neglect and three counts of child sexual abuse after the state took emergency custody of his nine children in 2011. A conviction on each count carries a potential life sentence.

The Associated Press is not identifying the man in an effort to protect the identities of the children.

A local newspaper reports that LeFlore County District Judge Jon Sullivan granted a defense motion Monday for mistrial, saying an insufficient number of qualified jurors were available in the original 44-member jury pool.
