Norman eyes jail time for public drinking

NORMAN (AP) — Those caught drinking in public in Norman could be sentenced to up to 10 days in jail under a proposed new ordinance being considered by the city council.

The council is scheduled to consider the proposal during its regular meeting Tuesday night.

Assistant City Attorney Rebecca Frazier says the new ordinance is a request from the municipal court clerk's office. Currently, those caught drinking in public can receive a fine of between $50 and $500.

Frazier says the idea behind the new ordinance is to give municipal judges more discretion when sentencing chronic or repeat offenders.

She says the plan is not part of an effort to target students or game day crowds at University of Oklahoma football games.

be honest, as long as a person is being responsible this new ordinance won't matter anyways, I for one feel safer knowing that the idiots at the ballgames have more to think about prior to becoming completely wasted. Safety should come first before self indulgence....that is just my way of thinking though

I bet I know what this stems from. Rumors are that the U2 concert was a ridiculous show of drunk fans standing in line to get into the stadium. drinks in hand. While I'm against this ordinance, it is mostly because I know it is hypocritical. There is NO WAY they will be able to enforce this on OU Home game days. The last OSU/OU game I went to in Norman was a glorified beer fest. O'Connells and various other establishments had like contests to see who could drink the most out in the parking lots. Watch the legal language; it all depends on how they define "public" property and public drunkeness. Is O'Connells parking lot public? Is Joe Blow's front yard for party folks public?
And, the real kicker...if you have enough money and a good enough attorney, you're not going to serve jail time.

Bad idea. These sorts of ordinances strip the populace of an idea of fairness in our criminal justice system. I'd rather see a public intoxication law that gives you a right to a blood alcohol test. Because right now, you don't get one. As long as an officer says you are intoxicated you are guilty.

If the municipal court clerk is that concerned that chronic and repeat offenders need to be subject to incarceration in jail then they can simple direct the police to submit the public intox charges to the Cleveland County DA where they can be jailed up to 30 days. There, problem solved and it didn't take a new ordnance, just making use of existing laws.

I agree with Kevin, OKC .. no mention of increased fines, but they will have all those beds to fill in the new Cleveland County Jail. They can't enact this with the old jail still operating because they are at capacity most days.

I also agree with James, Norman & Eric, OKC ... if this is for repeat offenses write a city ordinance for repeat offenders.

Norman like many other Oklahoma towns have a few officers that are undertrained & bully the citizens & visitors, as well as many fine officers that are very well trained & wonderful community servants.

Norman City leaders should really consider dropping all these social ordinances they've enacted lately and not enact any others. What used to be our nice diverse town in central Oklahoma has steadily gained more of these idiots who want the government to censure anything they find objectionable for their 'fam-lies' well being. Don't really mind if they want to live in Norman, just quit trying to turn it into Edmond-South! If you don't really want diversity & liberal governance in your community, then Norman is probably not the city you'll want to move to.

A few years ago I was on campus corner at the old Red Dirt Cafe. When I came out after seeing a friend play, there was a sign on all the parking meters saying that any car left overnight would be towed and impounded. Though I hadn't been drinking that night I wondered about the hundreds of other people there that night who, instead of calling a cab, decided that they would rather risk driving drunk than having their car impounded. WTF goes on with the Norman PD. I guess if they cand screw you laying down, they'll screw you standing up!

Not all Norman cops are bad. I (barely) remember once walking drunk down the middle of Lindsey at 4 am and getting stopped by the cops. I told them I was walking home and they gave me a ride back. They were just glad I wasn't driving!

I have been thrown into cab by norman pd because I came out of a bar downtown while my wife was talking on the phone. We had just gotten there and had only had a beer a piece. The cop was a jerk and forced three sober people to take a cab home. The irony is that is what we were going to do take a cab at the end of the night anyway. So we took another cab to the mont after the first one dropped us off.
I don't trust the Norman PD at all.

I am starting to hate living in Norman because of the bull shit laws they make. I guess they need this law to pay for more police they are hiring that we don't need. Norman cops only want the easy money because when my jeep got broken into they just write a report and thats it and don't finger print it or anything. Cas all the city leaders are stupid.

Are you kidding me? If they do that, my Saturdays @ Norman are OVER. Maybe a flask would be a good investment! Ms. Frazier, with all do respect, find another campaign to feel good about. Maybe meth production?? Leave the gameday crowds alone. You might want to check with the merchants before you do something really stupid like this. For a college town, the governing body of Norman leaves alot to be desired. When we come there for a game, we stay and party and eat and then take a taxi to the hotel. That's what law abiding people do. Now just shut up and go to your room.

i agree with james....why throw out the baby with the bathwater? if the "target" is repeat offenders, then by all means deal with repeat offenders, but do not expose anyone who is drinking (which is still legal) in public to jail time......give me a break.

If the purpose is to deal with "repeat offenders," then pass an ordinance increasing the punishment for repeat offenses. No need to subject everyone to a threat of 10 days in jail for being caught performing a legal act in *gasp* public.
