DEL CITY — A felon has been jailed on a homicide complaint after firing a shotgun through an apartment window and hitting a man outside, police Capt. Jody Suit said.
Keaunce Mustin, 37, of Del City, was shot and killed about 3:20 a.m. Saturday outside an apartment at 3447 SE 44.
Police arrested Phillip L. Davis, 38, of Oklahoma City, after interviewing him at the police department, according to a probable cause affidavit filed in Oklahoma County District Court.
Davis told investigators he was spending the night at the apartment when the woman who lives there woke him and said someone was trying to break in, the affidavit states.
He told police he took a 12-gauge shotgun and entered the living room, where he heard what sounded like glass breaking, so he fired one round, according to the affidavit.
A woman had called police and reported a burglary in progress. When officers arrived they found Mustin dead outside the apartment. Investigators said the shotgun blast went through the glass of the window and hit Mustin in the chest. They found no glass shards inside the living room window where Davis reported hearing someone breaking in, the affidavit states.
Three children also were in the apartment at the time, police said.
Davis has served time in prison on convictions in Oklahoma, Cleveland and Garfield counties on various charges, including drug possession and burglary.
He was being held in the Oklahoma County jail without bail.
