Oklahoma County District judge suspends man's prison sentence

“I was never really satisfied with it,” Deason said. “Something just didn't quite fit.”

A jury convicted Milton, 31, of first-degree robbery in May 2011 but acquitted him of murder in the shooting death Michael Jacob Brooks at an eastside apartment complex.

Prosecutors had charged Milton with first-degree murder or the alternative, murder during the commission of a robbery.

Milton's first trial ended in a mistrial after jurors deadlocked 11-1 for acquittal.

“I think it was proof that the system works,” said Kent Bridge, Milton's attorney. “I don't know that every judge would have done it.”

Prosecutors declined to comment on the ruling.

Police found Brooks wounded inside a parked sport utility vehicle on Dec. 22, 2009. He died at a hospital. Witnesses told police they were robbed by three men at the apartments. Brooks was hiding in the vehicle when he was shot.
