Oklahoma County prosecutors have declined to file charges against a state Corrections Department probation officer accused of sexually assaulting a developmentally disabled boy.
Robert Naugle, 33, was accused of sodomizing the boy during visits to Naugle's house when the boy was 16, according to a search warrant affidavit for Naugle's residence.
Midwest City police investigated the allegations and presented results of the investigation to the district attorney's office, which declined to prosecute because of “insufficient evidence.”
“We were not able to corroborate enough details of the crime as alleged to prove it beyond a reasonable doubt,” First Assistant District Attorney Scott Rowland said.
The boy, 17, told a Department of Human Services worker in June that he was sexually abused by Naugle a year earlier while living in Midwest City.
The DHS worker told police the boy has an IQ of 68, police reported. An IQ test score below or around 70 — or as high as 75 — indicates a limitation in intellectual functioning, according to the American Association of Intellectual and Developmental Disabilities.
The boy said the alleged abuse would take place in Naugle's bedroom while they watched a “porn video,” adding that Naugle would play the video each time the abuse took place, police reported.
Police reviewed 11 VHS tapes seized from Naugle's residence in Midwest City, but found “no pornographic videos,” search warrant documents show.
