The lawsuit alleges Joe Wesley Hart, 31, of Shawnee died Jan. 6 from injuries suffered during an altercation at FireLake Grand Casino, 41207 Hardesty Road.
Hart was at the casino as a customer. During the altercation, he was repeatedly struck, handcuffed and thrown to the floor, according to the lawsuit.
Mary Bell Ouart, Hart’s mother, filed the lawsuit, which lists Citizen Potawatomi Nation police officers Rick Fleming and Rick Irwin as defendants, along with Pottawatomie County and three unidentified casino security officers.
The county was listed as a defendant because Fleming and Irwin are also sheriff’s deputies, according to the lawsuit.
