Cherokee Nation to appeal judge's decision in poultry lawsuit

TULSA — The Cherokee Nation has filed a notice to appeal a federal judge's ruling that blocked the tribe from intervening in Oklahoma's water pollution lawsuit against the Arkansas poultry industry.
Cherokee Nation Attorney General Diane Hammons filed notice Thursday that the tribe would take its case to the 10th U.S. Circuit Court of Appeals in Denver.
On Tuesday, U.S. District Judge Gregory K. Frizzell denied the tribe's request to be added as a plaintiff in the case, paving the way for the trial to begin Thursday.
Oklahoma sued the poultry companies in 2005, claiming that the over-application of chicken waste in the Illinois River watershed has damaged the environment.
