Amber Hilberling testified in her own defense. She has been charged with killing her husband, Joshua Hilberling, 23, who fell from the apartment onto the top of a parking garage in 2011. Her attorneys called the death a “tragic accident,” but prosecutors say Amber Hilberling was angry because her husband was leaving her.
Amber Hilberling told jurors that she was seven months pregnant at the time and feared for her safety.
“We started arguing. I don't remember exactly what was said,” she testified. “We were getting closer to each other. Josh was really frustrated and grabbed my shoulders, and I pushed him off me.
“I remember watching him go through the glass,” she sobbed.
A defense witness testified earlier Friday that he found the windows in the apartment to be “unusually thin” and not well-maintained.
The expert, Mark Meshulam, testified that the glass installed in the nearly 50-year-old apartment complex is classified in the industry as “single strength” and would be more suited for small windows and picture frames. Meshulam said in his 30-plus years of experience, he had never seen that type of glass used in high-rise buildings.
