LAWTON — Former state Rep. Ron Kirby has resigned as Comanche County commissioner amid an ongoing investigation into allegations he had a detention center employee help him download hundreds of pornographic images from his cellphone to his work laptop computer.

Some of the pictures allegedly depicted the head of a female employee of his office “positioned on a nude female body with her breast and genitalia exposed,” according to a request for a search warrant submitted by an Oklahoma State Bureau of Investigation agent.

Kirby, 72, resigned Feb. 13 — just three days after the OSBI executed a search warrant on his office and seized a laptop computer, cellphone and memory card, records reveal.

The OSBI agent reported that the commission employee said she found Kirby shredding documents in his office after she had reported allegations of Kirby's activities to Assistant District Attorney Jerry Cude. The employee said she later retrieved the documents and discovered they included nude pictures that the employee previously had seen in Kirby's desk.

Kirby and Cude did not return calls Monday seeking comment.

Comanche County District Attorney Fred Smith declined to discuss the case, saying, “It is not my policy to comment on pending matters and I respectfully decline to do so in this case.”

No criminal charges had been filed as of Monday afternoon.

Transferring copies

According to the OSBI affidavit, a detention center employee became aware of the nude images when Kirby allegedly asked him for assistance in transferring copies of pornographic images and photographs that were taken with Kirby's cellular phone to a memory card Kirby had secured in his desk.

While assisting Kirby in using his work laptop computer to make the transfer, the detention center employee said he noticed that three or four of the pictures consisted of the head of one of Kirby's female employees positioned on a nude body.

The detention center employee told the agent that he also noticed the trash bin on Kirby's laptop computer contained evidence that Kirby had “visited pornographic sites and downloaded pornographic videos.”

The detention center employee told the woman whose face appeared in the pictures about the images after hearing she was experiencing problems with Kirby at work.
